Return Terms
Article 6 - Right of Withdrawal*
In the case of product delivery:
1. When purchasing products, the consumer has the option to dissolve the contract without stating reasons for a period of 14 days. This reflection period begins on the day after the consumer, or a representative designated by the consumer in advance and made known to the entrepreneur, receives the product.
2. During the reflection period, the consumer will handle the product and packaging with care. He will only unpack or use the product as necessary to determine whether he wishes to keep the product. If he makes use of his right of withdrawal, he must return the product with all accessories supplied and, if reasonably possible, in its original condition and packaging to the entrepreneur, in accordance with the reasonable and clear instructions provided by the entrepreneur.
3. If the consumer wishes to exercise his right of withdrawal, he is obliged to inform the entrepreneur of this within 14 days after receiving the product, using the model form or the return form in the webshop. After the consumer has indicated that he wishes to make use of his right of withdrawal, the customer must send back the product within 14 days. The consumer must prove that the products have been returned on time, for instance by means of a proof of shipment with tracking.
4. If the customer does not indicate that he wishes to exercise his right of withdrawal or if the product is not returned to the entrepreneur after the periods mentioned in sections 2 and 3, the purchase is a fact.
5. In addition to the legal period, Wetronic offers an additional reflection period of 86 days, resulting in a total reflection period of 100 days. This period is only valid for products without the mention of being specially ordered, which are in the original complete packaging and can be sold as they were delivered to the customer. This additional period is exclusively limited to the return obligation concerning the products themselves. Outside the 14-day period, the shipping costs incurred will not be reimbursed.
In the case of service delivery:
5. When delivering services, the consumer has the option to dissolve the contract without stating reasons for at least 14 days, starting on the day of entering into the agreement.
6. To exercise his right of withdrawal, the consumer will follow the reasonable and clear instructions provided by the entrepreneur in the offer and/or at the latest upon delivery.
Extended reflection period of 100 days
The following conditions apply to the extended reflection period of 100 days after the expiry of the 14-day legal reflection period:
1. The product must be unused and the packaging must be in neat and complete condition.
2. Products made to measure cannot be returned.
3. Products that have been specially ordered will not be accepted as returns.
In-store purchases
For returns in the store, a number of additional rules apply:
1. The product must be unused and the packaging in neat and complete condition.
2. Products made to measure cannot be returned.
3. Products that have been specially ordered will not be accepted as returns.
Article 7 - Costs in the event of withdrawal
1. If the consumer makes use of his right of withdrawal, he will bear no more than the cost of returning the goods.
2. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal, on the condition that the product has already been received back by the web retailer, or conclusive evidence of complete return can be provided. The refund will be made using the same payment method used by the consumer unless the consumer explicitly authorizes another payment method.
3. If the product is damaged due to careless handling by the consumer, the consumer is liable for any depreciation of the product.
4. The consumer cannot be held liable for any diminished value of the product if the entrepreneur has not provided all legally required information about the right of withdrawal before the conclusion of the purchase contract.
Article 8 - Exclusion of the right of withdrawal
1. The entrepreneur may exclude the consumer's right of withdrawal for products as described in sections 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, or at least in time before the contract is concluded.
2. Exclusion of the right of withdrawal is only possible for products:
a. that have been created by the entrepreneur according to the consumer's specifications;
b. that are clearly personal in nature;
c. that by their nature cannot be returned;
d. that can spoil or age quickly;
e. whose price is subject to fluctuations in the financial market on which the entrepreneur has no influence;
f. for loose newspapers and magazines;
g. for audio and video recordings and computer software whose seal has been broken by the consumer;
h. for hygienic products whose seal has been broken by the consumer.
3. Exclusion of the right of withdrawal is only possible for services:
a. concerning accommodation, transport, restaurant business, or leisure activities to be carried out on a specific date or during a specific period;
b. the delivery of which has begun with the consumer's explicit consent before the reflection period has expired;
c. concerning betting and lotteries.
Article 10 - Compliance and Warranty
1. The business ensures that the products and/or services comply with the contract, the specifications stated in the offer, reasonable requirements of reliability and/or usability, and the statutory provisions and/or government regulations existing at the time the agreement was formed. If agreed, the business also ensures that the product is suitable for other than normal use.
2. A warranty provided by the business, manufacturer, or importer does not detract from the legal rights and claims that the consumer can enforce against the business based on the agreement.
3. Any defects or incorrect products must be reported to the business in writing within 4 weeks after delivery. Return of the products should be done in the original packaging and in new condition.
4. The warranty period of the business corresponds to the factory warranty period. However, the business is never responsible for the ultimate suitability of the products for each individual application by the consumer, nor for any advice regarding the use or application of the products.
5. The warranty does not apply if:
· The consumer has repaired and/or modified the delivered products themselves or had them repaired and/or modified by third parties;
· The delivered products have been exposed to abnormal conditions or are otherwise treated carelessly or contrary to the instructions of the business and/or treated on the packaging;
· The defect is wholly or partially a result of regulations that the government has set or will set regarding the nature or quality of the materials used.
6. Repair of a detected non-conforming product is free of charge for consumers within the EU.
7. If it is found that the defect is not due to a production error but a mistake or result of the user's action, then an investigation cost of € 25 euro is charged. The return shipping costs are then to be borne by the customer.
